Directing my said Executrix to pay all my just debts
and funeral expenses
and the legacies herinafter give out of my estate.
Second-After the payment of my said debts and funeral
expenses,
I give to my wife, Amelia Vaughan all my real and
personal Estate,
consisting of Lands, Negroes, goods, chattles,
moneys and effects. Thereby
constituting her my sole heir during her life,
provided that my three children,
Jane Vaughan, Josephine Vaughan, and Josiah B Vaughan
shall equally
share my estate and share alike in the following
manner.
Third-I will that as my heirs become of age that
my executrix Amelia
Vaughan give to each of them an equal share of
my property in such
division as will leave in her hands and for her
support at least one-third
of my property during her life and then be divided
equally so that my heirs
share and share alike.
Fourth-Should any or either of my heirs marry before
becoming of lawful
age, they shall be deamed of age from the date
of such marriage and entitled
to share as if of lawful age.
No fifth point in document.
Sixth-I reserve to my Executrix Amelia Vaughan,
the legal
wright (sic) to give my Daughters their equal property
to
themselves and their heirs alone, if she may thinks
such security
for my daughters advisable.
Seventh-I furthermore authorize and empower my Executrix,
Amelia Vaughan to sell such portion of my Real
estate as she may think
advisable and advantageous to do so for the benefit
of herself and my heirs
and I furthermore will that such deed of conveyance
for real Estate made
by my Exectrix Amelia Vaughan be good and valid
in law. In testimony
whereof I hereunto set my hand and seal and
publish and declare this to
be my last will & testiment in the presence
of the Witnesses named below
this twenty first day of December AD 1846.
